I (we) agree that Wildcat Mountain Ski Area, Inc., its employees, representatives, assigns, sponsors and suppliers to the Wildcat Tracks Training Center Ski & Snowboard School program hereinafter referred to as "PROVIDERS" will not be responsible for any personal injury suffered by my (our) child in the Wildcat Tracks Training Center Ski & Snowboard School program, and I hereby release and discharge them from any claim or cause of action relating to any such personal injury. The undersigned approve this release, waive any rights in the premises, and agree to fully indemnify and hold harmless "PROVIDERS" from and against any loss, liability, damage, cost and expense which "PROVIDERS" may incur or sustain relating to any personal injury suffered by said minor in the Wildcat Tracks Training Center Ski & Snowboard School program. I certify that the minor child contemplated in this consent form is physically fit to participate in the Wildcat Tracks Training Center Ski & Snowboard School program.

Rental & Liability Release Agreement

I accept for use as is the equipment listed on the form attached hereto, and accept full financial responsibility for the care of the equipment while it is in my possession. I will be responsible for the replacement at full value of any equipment rented under the rental agreement, but not returned to the shop. I agree to return all rental equipment by the agreed date within 30 minutes of lifts closing to avoid additional charges.

I understand that the binding system cannot guarantee the user's safety. In downhill skiing, the binding system will not release at all times or under all circumstances where release may prevent injury or death, nor is it possible to predict every situation in which it will release. In snowboarding, cross-country skiing and SnowBlade use, the binding system will not ordinarily release during use: these bindings are not designed to release as a result of forces generated during ordinary operation.

I understand that the sports of skiing, snowboarding, SnowBlade and other recreational activities involve inherent and other risks of INJURY and DEATH. I voluntarily agree to expressly assume all risks of injury or death that may result from skiing/snowboarding/SnowBlade use, or which relate in any way to the use of this equipment.

I AGREE TO RELEASE the ski/snowboard shop, its employees, owners, affiliates, agents, officers, directors, and the manufacturers and distributors of this equipment (collectively "PROVIDERS"), from all liability for injury, death, property loss and damage which results from the equipment user's participation in the sport of skiing/snowboarding/SnowBlade use, or is in any way related to use of this equipment, including all liability which results from the NEGLIGENCE of PROVIDERS, or any other person or cause.

I further agree to defend and indemnify "PROVIDERS" for any loss or damage, including any that results from claims or lawsuits for personal injury, death and property loss and damage related in any way to the use of the equipment.

This agreement and release shall be governed by the applicable laws of the State of New Hampshire. If any provision hereof shall be determined to be unenforceable, it shall not affect the validity of the remaining provisions, which shall be given full force and effect.

Parent/Guardian: I verify that I am the parent/guardian of the minor, and I have the authority to enter into this agreement of release on behalf of the minor, and I agree to be bound by the terms and conditions hereof.
